Terms of Use

These Terms of Use govern your access to and use of the MochiModo website and products and services published by MochiModo, LLC.

Certain products may also have additional product-specific terms, purchase terms, or feature terms that apply to those products.

You must be legally capable of entering into a binding agreement to use the service. Certain products may have additional eligibility requirements, including higher minimum age requirements.

If a product requires an account, you are responsible for providing accurate information, maintaining the confidentiality of your credentials, and notifying us if you believe your account has been accessed without authorization.

MochiModo provides websites, mobile apps, AI-assisted features, subscription-based features, and experimental products. We may change, suspend, or discontinue all or part of a service at any time.

You may not use our services to violate law, infringe third-party rights, upload content you do not have the right to use, bypass safety controls or usage limits, or generate unlawful, deceptive, abusive, exploitative, or harmful content.

You retain any rights you have in the content you submit, such as text, prompts, photos, media, files, and other materials. You grant MochiModo a non-exclusive license to host, process, transmit, and otherwise use that content as necessary to operate, secure, support, and improve the service.

If a product generates results, outputs may not be unique and may be incomplete, inaccurate, inappropriate, or unavailable. You are responsible for reviewing and deciding whether to use, publish, share, or rely on any output.

MochiModo may use third-party providers, including app stores, payment vendors, hosting providers, analytics providers, subscription infrastructure providers, and AI providers such as OpenAI, Anthropic, and Google.

If you purchase a subscription or other paid feature through Apple App Store or Google Play, billing, renewals, cancellations, and refunds are generally governed by the applicable storefront and its policies.

The MochiModo services, including software, branding, interfaces, and related intellectual property other than your submitted content and applicable rights in generated outputs, are owned by MochiModo or its licensors and protected by law.

The service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee that the service will be uninterrupted, secure, error-free, or suitable for any particular purpose.

To the maximum extent permitted by law, MochiModo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising out of or relating to the service or these terms.

We may update these terms from time to time. If we make material changes, we may provide notice by posting updated terms, updating the effective date, or through other reasonable means.
